利用規約Terms of Use

1. 適用1. Scope

本利用規約（以下「本規約」）は、nejigram（以下「当事業者」）が提供するモバイルアプリケーション及びウェブサイト nejigram.com（以下あわせて「本サービス」）の利用条件を定めるものです。利用者は、本サービスをダウンロード又は利用することにより、本規約に同意したものとみなされます。 These Terms of Use ("Terms") govern your use of the mobile applications and the website nejigram.com (together, the "Service") provided by nejigram ("we"). By downloading or using the Service, you agree to these Terms.

2. 契約の当事者2. Parties to this agreement

本規約は、利用者と当事業者との間の契約であり、Apple Inc.（以下「Apple」）及び Google LLC（以下「Google」）は本規約の当事者ではありません。本サービスの内容及び本規約に関する責任は、Apple 及び Google ではなく、当事業者が負います。 These Terms are an agreement between you and nejigram only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). nejigram, not Apple or Google, is solely responsible for the Service and its content.

3. ライセンスの範囲3. Scope of licence

当事業者は利用者に対し、本アプリを、利用者が所有又は管理する端末上で、個人的かつ非商業的な目的に限り利用する、譲渡不可・非独占の権利を許諾します。App Store から取得された本アプリの利用は、Apple の「App Store サービス利用規約」に定める使用ルールに従うものとし、Google Play から取得された本アプリの利用は Google Play の利用規約に従うものとします。本規約は、本アプリの所有権を移転するものではありません。 We grant you a non-transferable, non-exclusive licence to use the app on any device that you own or control, for personal, non-commercial purposes. Use of an app obtained from the App Store is subject to the Usage Rules in the Apple Media Services Terms and Conditions; use of an app obtained from Google Play is subject to the Google Play Terms of Service. These Terms do not transfer ownership of the app to you.

4. アカウント4. Accounts

本サービスの一部機能はアカウントの登録を必要とします。利用者は、登録情報を正確に保ち、認証情報を第三者に開示しない責任を負います。アカウントの削除は、アプリ内の設定画面から行うことができます。 Some features require an account. You are responsible for keeping your registration details accurate and for not disclosing your credentials to others. You can delete your account from within the app's settings.

5. 未成年者の利用5. Use by minors

未成年者が本サービスを利用する場合は、親権者その他の法定代理人の同意を得た上でご利用ください。アプリ内課金についても、あらかじめ法定代理人の同意を得た上でお申し込みください。意図しない課金を防ぐため、端末側の購入制限機能（App Store の「スクリーンタイム」、Google Play の「購入時に認証を必要とする」設定）のご利用をおすすめします。 If you are a minor, please use the Service only with the consent of a parent or other legal guardian, and obtain that consent before making any in-app purchase. To prevent unintended purchases, we recommend using the purchase restrictions available on your device (Screen Time on the App Store, or requiring authentication for purchases on Google Play).

6. アプリ内課金・サブスクリプション6. In-app purchases and subscriptions

本アプリには有料の機能又はコンテンツが含まれる場合があります。価格は各アプリ内の購入画面に表示されます。購入契約は、利用者と各配信プラットフォーム事業者（Apple 又は Google）との間で成立し、決済は当該プラットフォームのアカウントに登録された決済手段により行われます。 The apps may include paid features or content. Prices are shown on the purchase screen inside each app. The purchase is transacted between you and the distribution platform (Apple or Google) and charged to the payment method registered with your platform account.

自動更新サブスクリプションは、現在の期間の終了の24時間前までに解約されない限り自動的に更新され、同額が課金されます。解約は、App Store の場合は「設定」>「Apple アカウント」>「サブスクリプション」、Google Play の場合は Play ストアの「定期購入」から行ってください。本アプリを削除しても解約にはなりません。 Auto-renewing subscriptions renew automatically at the same price unless cancelled at least 24 hours before the end of the current period. To cancel, use Settings > Apple Account > Subscriptions on the App Store, or Subscriptions in the Play Store on Google Play. Deleting the app does not cancel a subscription.

デジタルコンテンツの性質上、購入後の返品・交換には応じられません。返金は販売者である各プラットフォーム事業者の規定・手続きに従います。詳細は事業者情報・販売条件をご確認ください。 Because these are digital goods, purchases cannot be returned or exchanged. Refunds are governed by the policies and procedures of the platform that sold the item. See Business Information for details.

7. 広告7. Advertising

本アプリには、第三者の広告配信事業者による広告が表示される場合があります。広告の内容及び広告主のサービスについて、当事業者は責任を負いません。広告配信に伴う情報の取り扱い及びオプトアウトの方法は、プライバシーポリシーに定めるとおりです。 The apps may display advertising served by third-party ad networks. We are not responsible for the content of those advertisements or for the advertisers' services. How information is handled for advertising, and how to opt out, is described in our Privacy Policy.

8. 禁止事項8. Prohibited conduct

利用者は、本サービスの利用にあたり、以下の行為を行ってはなりません。 You must not do any of the following when using the Service.

• 法令又は公序良俗に違反する行為Violating any law or public order and morals
• 本アプリのリバースエンジニアリング、逆コンパイル、改変又は二次的著作物の作成Reverse engineering, decompiling, modifying the app or creating derivative works from it
• 本サービス又はサーバーに過度の負荷をかける行為、不正アクセスを試みる行為Placing an unreasonable load on the Service or its servers, or attempting unauthorised access
• 他の利用者又は第三者の権利を侵害する行為Infringing the rights of other users or third parties
• 当事業者の許諾なく本サービスを商業目的で利用する行為Using the Service for commercial purposes without our permission

9. 利用停止・アカウントの削除9. Suspension and account deletion

利用者が本規約に違反した場合、又は違反のおそれがあると当事業者が合理的に判断した場合、当事業者は、本サービスの全部又は一部の利用を停止し、又は利用者のアカウントを削除することができます。緊急を要する場合を除き、事前にその旨を通知します。当事業者は、これらの措置により利用者に生じた損害について、当事業者の故意又は重大な過失による場合を除き、責任を負いません。支払済みの有料期間が残っている場合の返金の取扱いは、販売者である各配信プラットフォーム事業者の規定に従います。 If you breach these Terms, or if we reasonably determine that you are likely to do so, we may suspend your use of all or part of the Service, or delete your account. Except in urgent cases, we will notify you beforehand. We are not liable for damage arising from these measures except in cases of our wilful misconduct or gross negligence. Where a paid period remains unused, any refund is governed by the policies of the distribution platform that sold it.

10. 利用者のコンテンツ10. Your content

利用者が本アプリ内に記録・保存したデータの権利は、利用者に帰属します。当事業者は、本サービスの提供・保守・不具合対応に必要な範囲でのみ当該データを取り扱います。利用者は、第三者の権利を侵害するコンテンツを本サービスに登録してはなりません。 You retain the rights to the data you record and store in the apps. We handle that data only to the extent necessary to provide, maintain and troubleshoot the Service. You must not upload content that infringes the rights of third parties.

11. 知的財産権11. Intellectual property

本サービスに関する著作権、商標権その他の知的財産権は、当事業者又は正当な権利者に帰属します。本規約は、これらの権利を利用者に移転又は許諾するものではありません。第三者の知的財産権の侵害を理由とする本アプリに関する請求については、当事業者が単独で責任を負い、Apple は責任を負いません。 All copyright, trademark and other intellectual property rights in the Service belong to us or to the respective rights holders, and these Terms do not transfer or licence those rights to you. nejigram, not Apple, is solely responsible for the investigation, defence, settlement and discharge of any claim that the app infringes a third party's intellectual property rights.

12. 保守及びサポート12. Maintenance and support

本アプリの保守及びサポートは、当事業者が単独で提供します。Apple 及び Google は、本アプリに関する保守及びサポートの義務を一切負いません。お問い合わせはサポートページより承ります。 nejigram is solely responsible for providing maintenance and support for the apps. Apple and Google have no obligation whatsoever to furnish any maintenance and support services for the apps. Please contact us through our support page.

13. 保証の否認13. Disclaimer of warranties

本サービスは現状有姿で提供され、当事業者は、法令で認められる範囲において、本サービスが利用者の特定の目的に適合すること、中断なく正常に動作すること、及び誤りがないことについて、明示又は黙示のいかんを問わず保証しません。 To the maximum extent permitted by law, the Service is provided "as is" and we make no warranty, express or implied, that it will meet your particular requirements, operate without interruption, or be free of errors.

本アプリが適用される保証に適合しない場合、利用者は Apple にその旨を通知することができ、Apple は当該アプリの購入代金を利用者に返還する場合があります。適用される法令で認められる最大限の範囲において、Apple はこれを超える保証上の義務を一切負わず、保証への不適合に起因する請求、損失、責任、損害、費用又は支出への対応は当事業者が責任を負います。 In the event of any failure of an app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are nejigram's sole responsibility.

14. 責任の制限14. Limitation of liability

当事業者は、本サービスの利用により利用者に生じた損害について、当事業者の故意又は重大な過失による場合を除き、責任を負いません。当事業者が責任を負う場合であっても、その範囲は、当該損害の発生時までの過去12か月間に利用者が本サービスに関して当事業者に支払った金額を上限とします。消費者契約法その他の法令により事業者の責任を免除できない場合、当該規定が適用されます。 Except in cases of our wilful misconduct or gross negligence, we are not liable for damages arising from your use of the Service. Where we are liable, our liability is limited to the amount you paid in respect of the Service in the twelve months preceding the event. Where mandatory law, including Japan's Consumer Contract Act, does not permit such limitation, that law prevails.

15. 製品に関する請求15. Product claims

本アプリ又は利用者による本アプリの保有及び利用に関する請求（製造物責任に関する請求、本アプリが法令上の要件に適合しないことを理由とする請求、及び消費者保護法令その他これに類する法令に基づく請求を含みます）への対応は、当事業者が責任を負い、Apple は責任を負いません。 nejigram, not Apple, is responsible for addressing any claims by you or any third party relating to the apps or your possession and/or use of the apps, including product liability claims, any claim that an app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.

16. 法令の遵守16. Legal compliance

利用者は、(i) 米国政府による禁輸措置の対象国又は米国政府が「テロリズム支援国家」として指定した国に所在していないこと、及び (ii) 米国政府の禁止又は制限対象者のリストに掲載されていないことを表明し、保証します。 You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

17. 第三者の利用条件17. Third-party terms

利用者は、本アプリの利用にあたり、適用される第三者の利用条件（利用者が契約する通信事業者のデータ通信プランの条件を含みます）を遵守しなければなりません。 You must comply with any applicable third-party terms of agreement when using the apps, including the terms of your wireless data service plan.

18. 第三受益者18. Third-party beneficiary

利用者及び当事業者は、Apple 及びその子会社が本規約の第三受益者であり、本規約の各条項を利用者に対して執行する権利を有することを確認します。 You and nejigram acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

19. 本規約の変更19. Changes to these Terms

当事業者は、法令の改正又は本サービスの内容の変更に応じて、本規約を変更する場合があります。重要な変更を行う場合は、本サービス内又は当サイトでお知らせします。変更後に本サービスをご利用いただいた場合、変更後の本規約に同意したものとみなされます。 We may amend these Terms to reflect changes in law or in the Service. We will announce material changes in the Service or on this site. Continuing to use the Service after a change means you accept the amended Terms.

20. サービスの変更・中断・終了20. Changes to or discontinuation of the Service

当事業者は、本サービスの内容を変更し、又はその提供を中断・終了することができます。有料の期間が残っている状態で当事業者の判断により本サービスを終了する場合は、本サービス内又は当サイトで事前にお知らせします。 We may change the Service, or suspend or discontinue it. If we discontinue the Service while a paid period is still running, we will give advance notice in the Service or on this site.

21. 準拠法及び裁判管轄21. Governing law and jurisdiction

本規約は日本法に準拠し、これに従って解釈されます。本サービスに関する紛争については、福岡地方裁判所を第一審の専属的合意管轄裁判所とします。 These Terms are governed by and construed in accordance with the laws of Japan. Disputes relating to the Service are subject to the exclusive jurisdiction of the Fukuoka District Court as the court of first instance.

ただし、利用者が消費者である場合において、利用者が居住する国又は地域の法令により、当該国又は地域の裁判所に訴えを提起する権利、当該国又は地域の法の適用を受ける権利、その他の消費者としての強行法規上の権利が保障されているときは、本条はこれらの権利に影響を及ぼしません。 However, if you are a consumer and the law of your country or region of residence guarantees you the right to bring proceedings in the courts of that country or region, the right to the protection of that law, or any other mandatory consumer right, nothing in this section affects those rights.

22. 分離可能性22. Severability

本規約のいずれかの条項又はその一部が法令により無効又は執行不能と判断された場合であっても、当該条項のその他の部分及び本規約のその他の条項は、継続して完全に効力を有します。 If any provision of these Terms, or part of a provision, is held invalid or unenforceable under applicable law, the remainder of that provision and all other provisions remain in full force and effect.
